Conmebol through its official website has issued a press release regarding the transfer of the licensing rights of the clubs that will participate in the league’s competitions, which we remember will be available from March 3 in FIFA 20 through a free DLC.
The current CONMEBOL directive considers a fundamental axis in its strategy of exposure and international reach of South American football, its presence in videogame platforms, in addition to assuming an important economic income for the promotion of continental football through the increase of prizes for its competitions, or the development of programs such as Evolution.
The Confederation informs that all the teams participating in CONMEBOL LIBERTADORES and CONMEBOL SUDAMERICANA sign a letter of conformity and commitment that contains their rights and obligations during their participation in the tournament. Regarding the exclusivity of a club, CONMEBOL points out that the presence of clubs is possible both in EA SPORTS and in another company that operates video games. In this regard, it should be noted that the club cannot assign its rights over its participation in CONMEBOL LIBERTADORES, since this is a right of CONMEBOL. However, the club may assign its own rights and thus appear in another context or categories within the videogame that is not within the framework of the CONMEBOL Libertadores, Sudamericana and Recopa.
Among the documents signed by the participating clubs is the technical manual of commercial and marketing rights applicable to all of them and which in its 2019 edition establishes the following:
“Licensing for Video Games: The rights licensed by the Clubs in this manual include, but are not limited to, the collective use of the image of players and coaches in groups and the use of the Club’s intellectual property assets (not limited to their brands, shields, uniforms, badges and pets) for unlimited use in video games in which tournaments will be presented. The aforementioned videogames may be marketed by CONMEBOL to third parties for commercial exploitation and the Clubs guarantee CONMEBOL that said rights are free of encumbrances or limitations. Any limitation for Unlimited exploitation of said rights must be previously informed to CONMEBOL, who will not have any responsibility towards the Clubs and third parties (players, coaches, etc.) ”
The current CONMEBOL directive commercially assigned the rights to videogames of its most popular tournaments – CONMEBOL LIBERTADORES, CONMEBOL SUDAMERICANA AND CONMEBOL RECOPA – to the company EA SPORTS with the express authorization of the clubs and their commitment to respect the aforementioned agreement. In this sense, previous directives reached similar agreements in previous seasons – 2013, 2014 and 2015 – with the company KONAMI, an agreement that was fully respected, as stipulated in the legal and commercial contracts of the institution.
